ludHOS Terms of Service (Payments & Billing)

1. Acceptance of Terms

These Terms of Service ("Billing Terms") govern purchases and subscriptions made through ludHOS's Stripe-powered checkout, across all ludHOS products, currently including Torchpost and Substack subscriptions. By making a purchase, you agree to these Billing Terms.

2. Relationship to Product-Specific Terms

These Billing Terms cover pricing, payment, billing cycles, cancellations, and refunds. They do not replace:

  • The Torchpost Terms of Service, which govern your use of the Torchpost platform.

  • Substack's Terms of Service, which govern your use of the Substack platform, including your Substack account, comments, and content access related to Games Without Borders.

If these Billing Terms conflict with a product-specific policy on a billing matter, these Billing Terms control.

3. Products

ludHOS currently offers the following paid products through this Stripe account:

  • Torchpost — month-to-month subscription access to the Torchpost platform

  • Games Without Borders — a paid Substack newsletter subscription, billed at the interval you select at signup (e.g., monthly or annually)

4. Payment Processing

All payments are processed by Stripe. By purchasing, you agree to provide accurate payment information and authorize ludHOS, through Stripe, to charge your chosen payment method for the applicable fees. ludHOS does not directly receive or store your full card information.

5. Subscriptions and Renewal

  • Torchpost subscriptions are billed month-to-month and renew automatically each month unless canceled before the renewal date.

  • Games Without Borders subscriptions renew automatically at the interval selected at signup, and can be managed or canceled through Substack.

  • You are responsible for cancelling before a renewal date if you don't want to continue.

6. Pricing

Prices are disclosed at checkout. ludHOS may change prices prospectively; existing subscribers will get at least 14 days' notice before a price change applies to their next renewal.

7. Cancellations and Refunds

  • You may cancel a Torchpost subscription at any time; cancellation takes effect at the end of the current billing period, and access continues until then.

  • Games Without Borders subscriptions are canceled through Substack's subscription management tools.

  • All payments are non-refundable except where required by law or expressly stated at the time of purchase.

8. Failed Payments

If a payment fails, ludHOS (or Stripe, on ludHOS's behalf) may retry the charge and/or notify you. Continued non-payment may result in suspension of access to the applicable product.

9. Taxes

Prices may not include applicable taxes. Where required, taxes are calculated and charged at checkout.

10. Accuracy of Billing Information

You agree to provide accurate, current billing information and to promptly update it if it changes (e.g., a new card or billing address).

11. Third-Party Platform (Substack)

Games Without Borders is distributed via Substack, which operates the reader-facing subscription checkout, account, and content delivery. Your use of Substack — including your Substack account, comments, and content access — is governed by Substack's own Terms of Service, over which ludHOS has no control. These Billing Terms govern only the payment relationship, which is processed through ludHOS's Stripe account.

12. Disclaimers

Purchases are provided on an "as-is" basis. ludHOS does not guarantee uninterrupted access to Torchpost or Games Without Borders and isn't responsible for outages or issues caused by Stripe, Substack, or other third-party providers.

13. Limitation of Liability

To the maximum extent permitted by law, ludHOS's total liability arising from a purchase will not exceed the amount you paid to ludHOS for the applicable product in the six (6) months preceding the claim.

14. Termination

ludHOS may suspend or terminate access to a paid product for non-payment, violation of that product's Terms of Service, or at ludHOS's discretion consistent with those Terms.

15. Governing Law

These Billing Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada.

16. Changes to These Terms

ludHOS may update these Billing Terms periodically, reflected in the "Last Updated" date above. For material changes, ludHOS will provide at least 14 days' notice before the changes take effect.
